These Terms of Service ("Terms") govern your access to and use of appeel.org and any purchase you make from it (together, the "Site"). The Site is operated by Appeel ("Appeel", "we", "us", "our") from Virginia, United States.

By browsing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree to them, please do not use the Site.

1. Who may use the Site

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that you meet that requirement and that the payment method you use is your own or that you have permission to use it.

Appeel currently sells to customers with delivery addresses in the United States only. We do not accept orders for delivery outside the United States.

2. Our products

Appeel sells household goods: items for the kitchen, bathroom, bedroom, lighting, cleaning, storage, pets, children, and general home use.

Images are illustrative. We work to show products accurately, but photography, screen calibration and manufacturing batches all vary. Color, finish and small details may differ slightly from what you see on screen.
Descriptions are provided in good faith. Measurements, capacities and performance figures come from our suppliers. Where a figure is described as tested or approximate, treat it as an indication rather than a guarantee.
Availability changes. Products may sell out or be discontinued without notice. We may limit the quantity of any item sold to one customer or one order.
We may correct errors. If a product, price or description is listed incorrectly, we may correct it, cancel affected orders, and refund you in full, even after an order has been confirmed.

3. Safe and sensible use of what you buy

Our products are intended for ordinary domestic use. They are not intended for commercial, industrial, medical or life-safety applications unless the product listing says otherwise.

Read and follow any instructions and warnings supplied with the product.
Electrical and battery-powered items must be used with the supplied or specified power source, kept away from water unless rated for it, and unplugged when not in use for long periods. Do not attempt to modify or repair them.
Items containing small parts, magnets, batteries or cords must be kept away from young children and pets. Adult supervision is required where a product is used by or near a child.
Items fixed to walls, ceilings, doors or furniture must be installed on a suitable surface using appropriate fixings, and their hold checked periodically. You are responsible for safe installation and for any damage installation causes.
Detection and alert devices, including gas, carbon monoxide and motion products, are convenience aids. They are not a substitute for professionally installed and certified safety equipment, and should not be relied upon as your only protection.

You assume responsibility for choosing a product suited to your purpose and for using it as intended.

4. Prices and payment

All prices are shown in United States dollars and exclude sales tax. Any tax that applies is calculated and added at checkout.
Shipping charges, where they apply, are shown at checkout before you pay. See our Shipping Policy for details.
Payment is processed by Shopify over an encrypted connection. Appeel does not see, handle or store your full card number.
We may refuse or cancel any order, including where we suspect fraud, an unauthorized payment method, a pricing error, or a resale or bulk-buying pattern. If we cancel an order you have already paid for, we refund it in full.

5. When your order becomes a contract

Placing an order is an offer to buy. The confirmation email you receive immediately afterwards acknowledges that we have your order; it is not our acceptance of it. A contract is formed only when we dispatch the goods, or notify you that they have been dispatched.

6. Shipping and returns

Delivery timings, costs and carriers are set out in our Shipping Policy. Your rights to cancel, return and obtain a refund are set out in our Refund Policy. Both policies form part of these Terms.

7. Your account

If you create an account, you are responsible for keeping your login details confidential and for everything done through your account. Tell us promptly if you believe it has been used without your permission. We may suspend or close an account that we reasonably believe is being used in breach of these Terms.

8. Acceptable use

You agree not to use the Site to break the law, infringe anyone's rights, transmit malicious code, scrape or harvest data, interfere with the Site's operation or security, impersonate anyone, or submit false information. We may restrict or withdraw access to anyone who does.

9. Reviews and anything else you submit

If you send us a review, comment, photograph, suggestion or other material, you grant Appeel a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with our business. You confirm the material is yours to give, is accurate, and does not breach anyone else's rights. We may edit or remove submitted material, and we are under no obligation to publish or keep it.

10. Our intellectual property

The Site's design, text, graphics, logos and compiled content belong to Appeel or its licensors and are protected by intellectual property law. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, sell or adapt any part of the Site without our written permission.

11. Third-party links

The Site may link to websites we do not control. We provide those links for convenience only. We are not responsible for the content, products, policies or security of any third-party site, and including a link does not mean we endorse it.

12. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

Nothing in these Terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded or limited, including rights you may have under applicable consumer protection law. Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Appeel will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the Site or any product bought through it.

Where liability cannot be excluded, our total liability to you for any claim is limited to the amount you paid for the product giving rise to the claim.

14. Indemnity

You agree to indemnify and hold harmless Appeel and its officers, employees and suppliers from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Site or any product.

15. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia and the federal laws of the United States, without regard to conflict-of-law rules. You and Appeel agree to the exclusive jurisdiction of the state and federal courts located in Virginia, except where applicable consumer law entitles you to bring proceedings elsewhere.

16. Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.

17. Changes to these Terms

We may update these Terms from time to time. The version in force is the one published on this page, and the "Last updated" date above tells you when it changed. Changes take effect when posted. Orders are governed by the Terms in force when the order was placed.
